Please read these terms carefully before using our service

1. Acceptance of Terms

Welcome to CineShorts. These Terms of Service ("Terms") govern your access to and use of the CineShorts mobile application ("App", "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting a notice in the App
• Sending an email to your registered email address
• Displaying a prominent notice when you next access the Service

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

3. Eligibility

To use CineShorts, you must:

• Be at least 13 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws
• Comply with all local laws regarding online conduct and acceptable content

If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account. You can register using:

• Email and password
• Social login providers (Google, Apple ID)

4.2 Account Information

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Not share your account credentials with others
• Notify us immediately of any unauthorized access to your account
• Accept full responsibility for all activities that occur under your account

4.3 Account Termination

You may delete your account at any time by contacting us or using the in-app account deletion feature. We may suspend or terminate your account if you violate these Terms.

5. Description of Service

CineShorts is a streaming platform that provides:

• Access to drama series, movies, and episodic content
• Personalized content recommendations
• Watch history and progress tracking
• Multiple viewing quality options
• Social features (watchlists, favorites, ratings)
• Free and premium subscription tiers
• In-app purchases (coins, episodes, subscriptions)
• Push notifications for new content and updates

6. Subscription and Payment Terms

6.1 Subscription Plans

We offer the following access options:

• Free Tier: Limited access to content with advertisements
• Premium Subscription: Unlimited access to all content without ads, charged on a recurring basis
• Coin-Based Purchases: Purchase individual episodes or content using in-app coins

6.2 Payment and Billing

• Subscription fees are charged in advance on a recurring basis (monthly, quarterly, or annually)
• Payments are processed through Apple App Store or Google Play Store
• You authorize us (and our payment processors) to charge your payment method on file
• All fees are in the currency displayed at the time of purchase
• Prices are subject to change with 30 days' advance notice
• You are responsible for all applicable taxes

6.3 Auto-Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your device's account settings (App Store or Google Play).

6.4 Free Trials

We may offer free trials. If you do not cancel before the trial ends, you will be charged the subscription fee. We reserve the right to limit free trial eligibility.

6.5 Refunds

Refunds are handled according to Apple App Store and Google Play Store policies. Generally:

• Subscription fees are non-refundable
• No refunds for partial subscription periods
• No refunds for unused coins or content
• Exceptions may be made at our sole discretion or as required by law

7. Content and Intellectual Property

7.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Content for personal, non-commercial use only.

7.2 Ownership

All Content, features, and functionality of the Service, including but not limited to:

• Videos, images, audio, and text
• Logos, trademarks, and service marks
• Software, code, and algorithms
• Design, layout, and user interface

are owned by us, our licensors, or other content providers and are protected by copyright, trademark, and other intellectual property laws.

7.3 Restrictions

You agree NOT to:

• Copy, download, reproduce, or distribute Content (except as specifically allowed)
• Modify, adapt, translate, or create derivative works from the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the Service or Content for commercial purposes without authorization
• Frame or mirror any part of the Service
• Use automated tools (bots, scrapers) to access the Service
• Circumvent any access restrictions or technological protection measures

7.4 Content Availability

Content availability may vary by region due to licensing restrictions. We reserve the right to add, remove, or modify Content at any time without notice.

8. User Conduct and Prohibited Activities

You agree to use the Service in compliance with all applicable laws and regulations. You will NOT:

• Violate any local, state, national, or international law
• Infringe upon the intellectual property rights of others
• Harass, threaten, defame, or harm other users
• Upload or transmit viruses, malware, or harmful code
• Engage in fraudulent, deceptive, or misleading activities
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any systems or accounts
• Collect or harvest personal information from other users
• Use the Service to distribute spam or unsolicited communications
• Engage in any activity that could damage our reputation or business

9. User-Generated Content

9.1 Content You Provide

You may be able to submit reviews, ratings, comments, or other content. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display such content.

9.2 Content Standards

You represent and warrant that your content:

• Does not violate any third-party rights
• Is not illegal, obscene, defamatory, or offensive
• Does not contain viruses or harmful code
• Complies with these Terms and applicable laws

9.3 Content Moderation

We reserve the right to review, monitor, and remove any user-generated content that violates these Terms or is otherwise objectionable, at our sole discretion.

10. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Third-Party Services and Links

The Service may contain links to third-party websites, services, or advertisements. We are not responsible for:

• Any transactions between you and third parties

Your interactions with third-party services are solely between you and the third party. We encourage you to review their terms and privacy policies.

12. Advertisements

The Service may display advertisements from third-party advertisers (Google AdMob). We do not control or endorse the content of these advertisements. Your interactions with advertisers are at your own risk.

13. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding accuracy, reliability, or availability
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the quality, content, or legality of any content

We do not guarantee that:

• Any content will be available at all times or in all regions
• The Service will be free from bugs, viruses, or technical issues
• Any errors will be corrected

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of business opportunities or reputation
• Service interruptions or system failures
• Any damages arising from your use or inability to use the Service

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations
• Any content you submit or transmit through the Service

16. Termination and Suspension

16.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the App.

16.2 Termination by Us

We may suspend or terminate your account and access to the Service immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your conduct harms other users, us, or third parties
• We are required to do so by law
• We discontinue the Service

16.3 Effect of Termination

Upon termination:

• Your right to use the Service will cease immediately
• You will lose access to your account and any purchased content
• We may delete your account data (subject to our Privacy Policy and legal obligations)
• No refunds will be provided for any unused subscription time or purchased content

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law principles.

17.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service:

• If informal resolution fails, disputes shall be resolved through binding arbitration or in the courts of Vietnam

17.3 Class Action Waiver

To the extent permitted by law, you agree that any dispute will be brought in an individual capacity, and not as a class action, collective action, or representative action.

18. Apple App Store and Google Play Store

18.1 Acknowledgment

If you access the Service through the Apple App Store or Google Play Store, you acknowledge that:

• These Terms are between you and us, not with Apple or Google
• Apple and Google have no obligation to provide support or maintenance
• Apple and Google are not responsible for the App or any claims related to it
• You will comply with the respective App Store Terms of Service

18.2 Third-Party Beneficiaries

Apple and Google are third-party beneficiaries of these Terms and may enforce them directly against you.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

19.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

19.5 Force Majeure

We will not be liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or technical failures.

19.6 Language

These Terms are provided in English. In case of any conflict between the English version and a translation, the English version shall prevail.
